Terms & Conditions

These Terms and Conditions (the “Terms”) govern your purchase of courses, workshops, webinars, and related materials (collectively, the “Courses”) offered by The Somatic Collective by FlowArt® (“Somatic Collective,” “we,” “us,” or “our”). By purchasing or accessing a Course, you agree to these Terms and to any Course-specific policies referenced here. If you do not agree, do not purchase or access a Course.

Somatic Collective is operated by FlowArt Therapy PLLC, a Washington professional limited liability company. Our contact information appears at the end of these Terms.


1. Who these Terms cover

1.1 Eligibility. You must be at least 18 years old and able to form a binding contract. You are responsible for ensuring a Course meets your learning needs and professional context.

1.2 Professional use. Courses are designed for education of mental health, sexuality, and allied professionals. Unless a Course specifically states otherwise, Courses are not intended for the general public or for minors.


2. What the Courses are (and are not)

2.1 Education, not therapy. Courses provide education only. Purchase or attendance does not create a therapy, supervisory, or clinical relationship with us. For clinical care, consult a licensed professional in your jurisdiction.

2.2 No guarantees. We do not guarantee outcomes, licensure approvals, board acceptance, employment, revenue, or client results. Examples and testimonials illustrate past experiences and are not promises of future results.

2.3 Scope of practice. You are responsible for using any information within your own professional scope, laws, and ethics codes.

2.4 Delivery formats. Courses are delivered as on-demand digital content or as live online sessions, as stated on the Course page.


3. Continuing education credit

3.1 Provider status and disclosures. Courses may be offered for continuing education (“CE”) credit through AASECT and/or NBCC, as indicated on the Course page. Each Course listing will specify the applicable sponsor or approved-provider designation, the number of CE hours, learning objectives, target audience, and any prerequisites.

3.2 Attendance and completion rules. Delivery may be on-demand or live online, as stated on the Course page. To earn CE credit (AASECT or NBCC), you must:
(a) complete all required instructional time,
(b) verify your identity as requested,
(c) complete the course evaluation, and
(d)
pass the post-course quiz or assessment at or above the minimum required score.
Partial credit is not issued unless explicitly stated for a particular Course.

3.3 Certificates. When all requirements are verified, we issue CE certificates electronically to the email used at registration, typically within 5 business days. You are responsible for safekeeping your certificate.

3.4 Board acceptance. Acceptance of CE credit depends on your licensing, certification, or credentialing body. Confirm eligibility prior to purchase.


4. Registration, pricing, and payment

4.1 How to register. Register through our website or a designated third-party platform. Registration is complete only after we or the platform confirm your payment.

4.2 Pricing. Prices are in United States Dollars and may change at any time before purchase. Sales tax may apply depending on your location and the platform used.

4.3 Payment methods. By providing a payment method, you represent you are authorized to use it and authorize us or the platform to charge the full amount, including applicable taxes and fees.

4.4 Payment plans. If a payment plan is offered, you must keep a valid payment method on file and make all scheduled payments. Access may be suspended for failed payments and will be terminated if a past-due balance is not resolved within 7 days. You remain responsible for any unpaid balance.

4.5 Discounts and coupons. Promotional pricing is valid only for the period stated and cannot be combined unless explicitly allowed.


5. Sales are final; cancellations

5.1 All sales final. Because access to digital educational content is delivered immediately upon purchase, or for live online events at the scheduled start time, we do not offer refunds, returns, or credits for any reason, including non-attendance, schedule conflicts, or change of mind.

5.2 Our cancellations or technical interruptions. If we cancel a live program or experience a platform-wide failure that prevents delivery, we will provide a rescheduled date or alternative access, for example a replay or on-demand access. If we are unable to provide an alternative within a commercially reasonable timeframe, we will comply with any refund required by applicable law. We are not responsible for other costs you may incur.

5.3 Chargebacks. Please contact us at [email protected] to attempt to resolve any billing issue before initiating a chargeback. Unfounded chargebacks may result in suspension of access and collection of any outstanding balance.


6. Access, accounts, and technology

6.1 Access window. Unless the Course page specifies otherwise, you receive a personal, non-transferable license to access on-demand Course materials for at least 12 months from purchase. We may offer extended access at our discretion.

6.2 Platform requirements. You are responsible for having a reliable internet connection and compatible device. We are not liable for access issues caused by your equipment, firewall, or internet service.

6.3 Accounts. Keep your login credentials confidential and do not share them. You are responsible for all activity under your account.


7. Intellectual property and permitted use

7.1 Ownership. All Course content, including videos, audio, slides, handouts, transcripts, names, logos, and marks, is owned by us or our licensors and is protected by intellectual property laws.

7.2 License to you. We grant you a limited, personal, non-exclusive, non-transferable license to access the Course for your own professional education. Except as allowed by law, you may not copy, distribute, adapt, record, post, resell, or create derivative works from the content without our written permission.

7.3 Attribution and citation. If a Course permits reuse of specific handouts or frameworks, you must follow any attribution and citation guidelines provided.


8. Community standards and conduct

8.1 Respect and inclusion. We expect a respectful learning environment that is trauma-informed and affirming of LGBTQIA+ people, neurodivergent people, people in consensual non-monogamy, and kink communities, as well as people of all races, genders, and abilities.

8.2 Prohibited behavior. Harassment, hate speech, discrimination, doxxing, and disruptive conduct are not permitted. We may remove participants who violate this standard without a refund.

8.3 Confidentiality in groups. If a Course includes discussions or role-plays, do not share other participants’ identifying details outside the Course. Do not disclose client identifying information. You are responsible for de-identifying case material in accordance with law and ethics.


9. Recordings, media, and your likeness

9.1 Recording. Some live Courses may be recorded to improve the Course or to provide replay access to registrants. The Course page will indicate if recording occurs. By attending, you consent to being recorded. If you prefer not to be recorded, do not enable your camera, mute your microphone, and avoid posting identifying information in the chat.

9.2 Use of chat and Q&A. We may anonymize and reuse participant questions to improve educational materials.

9.3 Marketing materials. We will not use your name, photograph, or likeness in public marketing without your consent.


10. Accessibility and accommodations

10.1 Commitment. We aim to make Courses accessible. Common accommodations include live captions, transcripts, and accessible slide formats.

10.2 How to request. Please email us at [email protected] at least 10 days before a live Course with your requested accommodation. We will confirm what we can provide and in what timeframe.


11. Privacy

11.1 Privacy policy. Our collection and use of personal data is described in our Privacy Policy, which is incorporated by reference. The Privacy Policy is available at: privacy.somaticcollective.com.

11.2 Third-party platforms. If a Course is delivered through a third-party platform, that platform’s terms and privacy policy apply in addition to ours.


12. Disclaimers and limitations of liability

12.1 No warranties. Courses are provided “as is” for educational purposes. We disclaim all warranties to the fullest extent permitted by law.

12.2 Limitation of liability. To the fullest extent permitted by law, our total liability for any claim arising from a Course or these Terms will not exceed the amount you paid for the Course giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

12.3 Indemnity. You agree to indemnify and hold us harmless from claims arising out of your misuse of the Course, violation of these Terms, or violation of law or third-party rights.


13. Grievances and customer support

13.1 How to submit a grievance. We take concerns seriously. Please email [email protected] with your name, the Course title and date, and a clear description of the issue. We will acknowledge receipt within 5 business days and aim to resolve within 15 business days.

13.2 Escalation. If you are not satisfied with the proposed resolution, you may request review by the Program Director at [email protected].


14. Changes to Courses and to these Terms

14.1 Course updates. We may update content to reflect new research or standards. Access windows will remain as stated at purchase.

14.2 Term updates. We may update these Terms by posting a revised version with a new effective date. Your continued access after the effective date constitutes acceptance of the revised Terms.


15. Governing law, venue, and notices

15.1 Governing law. These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules.

15.2 Venue. Exclusive venue for disputes is the state and federal courts located in Pierce County, Washington. You consent to personal jurisdiction in those courts.

15.3 Notices. Legal notices must be sent to: FlowArt Therapy PLLC, Attn: Legal Notices, 1600B SW Dash Point Rd #1017, Federal Way, WA 98023. We may send notices to the email you used at registration.


16. Miscellaneous

16.1 Severability. If a provision is found unenforceable, the remaining provisions remain in effect.

16.2 No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.

16.3 Assignment. You may not assign your rights or obligations under these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or other business transfer.

16.4 Entire agreement. These Terms, together with the Course description and our Privacy Policy, form the entire agreement regarding your purchase and access to the Course.
